Policy 508 - Leave of Absence for Military Spouses

Scope

This policy applies to staff, administrators and faculty who work 20 or more hours per week and who are employed on any New York campus of the University.

Policy

An eligible employee of the University who is married to a member of the armed forces of the United States, National Guard or Reserves shall be allowed up to 10 days of unpaid leave while his/her spouse is on leave from deployment to a combat theater or combat zone of operations during a period of military conflict.

“Period of military conflict” shall mean a period of war declared by the US Congress, or in which a member of a reserve component of the armed forces is ordered to active duty.

This leave does not affect or prevent the granting of any leave for military spouses afforded by the Family and Medical Leave Act or any other law.  

Procedures

This leave of absence is an unpaid leave.  Employees may elect to substitute all or part of the leave time with paid time off (accrued vacation or personal time).  To request a leave of absence under this policy, an employee must give as much advance notice as possible to his or her supervisor to allow adequate time for work reassignment and department coverage. 

The requesting employee must present his/her supervisor with a copy of the spouse’s military leave orders or other written documentation certifying that the requested leave dates coincide with the military member’s dates of leave from deployment. The supervisor should complete and forward an approved PCF and a copy of the written documentation to the Human Resources Services office.

Non-Retaliation

The University shall not retaliate against an employee for requesting or obtaining a leave of absence as provided in this policy.
