Unemployment insurance is a New York State Department of Labor program. It provides compensation to qualified workers during involuntary periods of unemployment. Eligibility, waiting periods, rates of compensation, and the duration of compensation payments are fixed by the New York State Unemployment Insurance Law. The University bears the full cost of this program on behalf of its employees.
In general, employees are disqualified for benefits if they quit voluntarily, are discharged for cause, unjustly refuse suitable work, are receiving workers’ compensation or Social Security, are involved in a labor dispute, or commit fraud. If an employee is terminated, the University must prove “cause” to avoid the unemployment claim. Supervisors should keep accurate records of each separation and document the reason for the termination of each employee.
