Policy 405 - Discretionary Time Off for Administrators (Exempt only)

Scope

This policy applies to all employees who meet the criteria for exemption from the overtime provisions of New York State and federal law. Generally, these employees are administrators and are on the semi-monthly pay cycle.

This policy does not apply to non-exempt employees. For overtime pay information for staff, refer to the University’s Overtime policy, #310.

Policy

There is no legal requirement to provide exempt employees (generally, administrators) with compensatory time off, nor are they eligible to receive overtime pay. Under extraordinary work circumstances only, the University may, at its discretion, grant discretionary time off to administrators.

It is not the intent of this policy to allow discretionary time off in amounts equal to extra time worked. That is, time off may not be given hour for hour or day for day; rather, it should be reserved for circumstances in which an administrator has demonstrated a work pattern characterized by significant extra hours, weekends, or holidays.
