Rationale: The new law on gun control recently signed by Gov. Andrew M. Cuomo has created a great deal of confusion among practitioners regarding its scope and specific requirements. To help us unravel what this and other related laws (such as the Kendra’s law) mean, who are likely to be affected, and to what extent will be the subject of this presentation /discussion. This issue is more urgent in view of our understanding that the NRA succeeded in introducing specific language in the Affordable Care Act that bans providers from documenting patient responses to questions that they may ask about guns at home (something likely to be asked if evaluating for suicide). Recognizing that much still needs to be understood and defined by the legislators before the NY Safe Act law goes into implementation, we will explore what is known and what the professional should consider with regard to the extent of his/her professional responsibility, including the issue of confidentiality.
