Risa Sugarman, head of the criminal investigations division at the state Department of Taxation and Finance, has been approved as the first-ever independent enforcement counsel at the state Board of Elections.
The new enforcement bureau was established in 2014-15 state budget legislation. The Division of Election Law Enforcement and the independent enforcement counsel will be empowered to pursue election law violations on their own initiative without requiring the approval of the four-member Board of Election, which by law is split between two Democrat and two Republican commissioners.
The counsel will also be able to cast a potential fifth tie-breaking vote on enforcement matters that come before the board.
